Terms of Service

By creating an account or using Koda, you agree to these terms. If you don't agree, don't use the service.

Koda is operated by Kodasocial.Co.Uk Ltd (trading as Koda), a company registered in England & Wales under company number 17266873 and part of the Arlo Marketing group. Registered office: Brook View Lodge, New Road, Teignmouth, TQ14 8UD.

1. The service

Koda is a software-as-a-service tool that helps creative agencies manage clients, plan content, schedule social media posts, and track engagement. We may change, add, or remove features over time. We'll give reasonable notice for any change that removes a feature you actively rely on.

You agree not to use Koda to:

We may suspend or terminate accounts that breach these rules.

4. Your content

You retain ownership of everything you put into Koda — your client lists, captions, posts, media. We get a limited licence to host and process it solely to operate the service for you. We don't use your content for advertising, model training, or any purpose beyond running Koda.

5. Client data and third-party accounts

When you connect an Instagram or other third-party account through Koda, you confirm you have permission to do so. You agree to Meta's platform terms when using Instagram/Facebook features. We're not responsible for actions taken on your behalf by Meta, including content removals, account restrictions or policy changes.

We aim for high uptime but don't guarantee uninterrupted service. We may need to take Koda offline for maintenance, security patches or emergency fixes. We'll give notice when we can.

8. Termination

You can delete your account at any time. We can suspend or close an account if you breach these terms, fail to pay, or use the service in a way that puts other users or third parties at risk. On termination, we delete your workspace data within 30 days unless we're required by law to retain it longer.

9. Limitation of liability

To the extent permitted by law, Koda's total liability to you for any claim arising from these terms or the service is capped at the amount you paid us in the 12 months before the claim. We're not liable for indirect, consequential or incidental losses (e.g. lost revenue, lost data, lost client relationships) except where the law says otherwise.

10. Indemnity

You agree to indemnify us against claims brought by your clients or other third parties relating to content you published through Koda, accounts you connected without authority, or breaches of these terms.

11. Changes to these terms

We may update these terms when the product or law changes. We'll update the date at the top and email signed-in users about material changes at least 14 days before they take effect. Continued use after that date counts as acceptance.

12. Governing law

These terms are governed by the laws of England and Wales. Disputes will be resolved in the courts of England and Wales.
